Big Win for US Tech: Rescission of the Biden Administration’s AI Export Rule

WASHINGTON - Last week, Congressman Rich McCormick (GA-07) and Congressman Scott Franklin (FL-18) took a significant step in advocating for American technological leadership by sending a letter to Commerce Secretary Lutnick urging him to reconsider the Biden administration's export rule on AI chips. Their letter followed Senator Pete Ricketts’ April 11th letter expressing the same concerns.

Bureau of Industry and Security Rule 00636 would have imposed stringent export controls on high-performance AI chips. While aimed at preventing our adversaries from buying up these chips, implementation would have threatened the growth and competitiveness of the U.S. tech sector. The administration concurred with Congressmen McCormick and Franklin and announced their decision Wednesday, May 7th, 2025 to rescind and redraft the rule, marking a significant victory for the technology industry and America’s global superiority in innovation.

The decision to rescind the Biden-era AI Diffusion Rule is a relief to many in the tech industry who expressed concerns about the potential negative impact of the rule on innovation and global competitiveness. By removing these overly restrictive export controls, the administration has demonstrated its commitment to fostering a thriving technology sector that can create high-paying jobs for Americans and bolster American national security. This move also sends a strong message to our international partners that the United States remains committed to leading the way in developing and deploying cutting-edge technologies.

The Biden Administration’s B.I.S. Rule 00636 jeopardized both by imposing broad restrictions on AI chip exports, even to key allies. The United States should be setting the pace in global innovation, not allowing China to take the lead.”

Congressmen McCormick and Franklin’s letter to the administration highlighted the need for a more balanced approach to regulating AI chip exports that prioritizes national security while allowing U.S. companies to compete effectively in the global market.
